This Privacy Policy describes the information OntarioNet collects from you, how it is used, how it is shared, your choices about uses and sharing, and your rights under certain privacy laws as it relates to your interactions with OntarioNet’s websites and services. For purposes of this Privacy Policy, OntarioNet’s websites include https://www.ontarionet.com and its subpages (collectively “Websites”), and OntarioNet’s services refers to any and all services offered by OntarioNet (the “Service” or collectively the “Services”).
1. NOTICE AT COLLECTION OF PERSONAL INFORMATION
A. The Personal Information we collect from you will depend on your use of, and interaction with, our Websites and Services. For purposes of this Privacy Policy, “Personal Information” means the information you provide to OntarioNet which personally identifies you, relates to you, or could reasonably be linked to you or your household. Such Personal Information may include:
Information You Provide to Us. We may collect contact, billing, and other information you provide to us, including your name, address, email, phone numbers, date of birth, and payment information.
Information Related to Your Use of Our Services. We may collect information about how you use our Services. This information may include call records, the websites you visit, information about the devices you use in connection with our Services and your bandwidth usage.
Information Collected When You Use Our Websites. We may also collect certain information when you visit our Websites, including information about your operating system and browser, IP address and device identification numbers, and web addresses of the websites you come from and go to next.
B. Personal Information does not include: i) publicly available information or information lawfully obtained, truthful information that is a matter of public concern; or ii) de-identified or aggregate consumer information. “De-identified or aggregate consumer information” means information that relates to an individual or group, from which individual consumer identities have been removed, and is not linked or reasonably linkable to any consumer or household, including via a device.
2. HOW ONTARIONET USES THE INFORMATION COLLECTED
A. We may use the information collected to:
Deliver and maintain the Service(s)
Establish and maintain your OntarioNet account records
Provide OntarioNet account-related services and information
Help you with service and technical support issues or questions related to our Websites or Services
Manage and protect our networks, services, employees and users
Detect and prevent fraud
Research, develop and market new products and services
Determine your eligibility for new products and services
Authenticate you
Contact you with business offers
Help train employees and support resources and systems to better serve you
3. ONTARIONET’S SHARING OF INFORMATION
A. We share de-identified and aggregate consumer information for research, analysis, and development purposes with other departments within the City of Ontario and with third parties OntarioNet has engaged for such purposes.
B. OntarioNet also shares your Personal Information with third parties it has engaged to perform tasks or services that directly support OntarioNet and OntarioNet’s maintenance and operations of its network, Websites and Services. We only share Personal Information as is necessary for these third parties to perform such work.
C. OntarioNet may offer certain products and/or services that are owned, managed, or operated by third parties. If you choose to purchase or use a third party’s products and/or services, OntarioNet must release some Personal Information to these companies in order for the third party to provide such product or service. The privacy policies of these third parties are not under OntarioNet’s control and may differ from OntarioNet’s Privacy Policy.
i. For example, OntarioNet residential customers have the option to download the OntarioNet Hub Mobile App in order to manage their OntarioNet WiFi and internal home network experience (“App”). If you choose to download the App, the information you enter, or otherwise provide, to the App shall be subject to the Calix CommandIQ® Mobile Application Privacy Policy.
a. To delete your App account: Login to App account > Select “Settings” > “Account and Admins” > “Edit” > “Remove Account.”
D. We share Personal Information with other departments within the City of Ontario for a variety of purposes, including providing you with the latest information about Services and offering our latest promotions. Notwithstanding the foregoing, OntarioNet will not share your Personal Information with the Ontario Police Department except in accordance with subsection (E) below.
E. In certain circumstances, we will share Personal Information outside of OntarioNet if we have a good-faith belief that disclosure of the information is reasonably necessary to:
i. Respond to any applicable law, regulation, legal process, or enforceable governmental request
ii. Enforce OntarioNet’s rights arising from our agreements with you
iii. Protect against harm to the rights, property or safety of OntarioNet, our users, or the public
These third parties may include, but are not limited to, law enforcement agencies, government
agencies, or legal counsel.
F. Additionally, as a public agency, the City of Ontario is subject to the California Public
Records Act (“CPRA”) (Gov. Code, § 7920.000), which may require the disclosure of non-
exempt public records. However, public records will be redacted to remove exempt customer
Personal Information to the extent allowed by law, including your name, your social security
number, your home address, your telephone number, credit history information, and your service
usage data.
4. LIMITED USE OF SENSITIVE PERSONAL INFORMATION
We do not use or disclose your sensitive Personal Information (for example, your financial information or your precise geolocation data) for purposes beyond what is needed to provide the Service or for other reasons specified in the law. These reasons include: detecting security incidents; resisting malicious, deceptive, fraudulent or illegal actions; ensuring the physical safety of a person; short-term, transient uses; performing services such as maintaining or servicing accounts, providing customer service, fulfilling orders and transactions; verifying your information; and verifying, maintaining or enhancing Services on your customer premises equipment. We do not use or disclose sensitive Personal Information for other purposes without your consent.
5. HOW LONG ONTARIONET RETAINS THE INFORMATION COLLECTED
We retain records containing Personal Information for as long as they are needed for the Service delivery, legal, tax, audit, investigative, and/or security purposes, to the extent the records are subject to the City’s Records Retention Schedule, the retention will generally exceed 12 months and will vary based on the type of record. We incorporate Personal Information into different types of records; it is not always retained by distinct data elements. For example, your name is part of your account, technical support and call detail records.
6. YOUR CHOICES ABOUT ONTARIONET’S USE OF YOUR PERSONAL INFORMATION
A. Review Your Information. You can email us at careteam@ontarionet.com to set up an appointment to review the Personal Information we have about you. You can only review records that contain your Personal Information, and you’ll have to provide proper identification to do so.
B. Correct or Delete Your Information. We’ll work with you to correct inaccurate information in our records if necessary. You can also request that we delete Personal Information that we have about you unless we need it for specific reasons (e.g., needing the information to provide the Service and other activities needed to maintain an ongoing business relationship or perform a contract with you, to maintain information security, to exercise legal rights and to comply with other laws, including, without limitation, applicable state records retention laws).
C. Request and Receive Your Information. You may request any Personal Information collected and/or shared by OntarioNet in the preceding twelve (12) months by emailing your request to careteam@ontarionet.com or by calling our toll-free phone number at 844-668-3423.
D. Opt-Out. You have the right to opt-out of the sharing of the Personal Information we collect from you with some exceptions. Common exceptions include if the sale or sharing is necessary for OntarioNet to comply with its legal obligations, exercise legal claims or rights, or defend legal claims. OntarioNet customers can adjust their own marketing preferences in accordance with the below:
i. Emails: Opt out of receiving marketing-related emails by following the unsubscribe instructions at the bottom of marketing emails you receive.
ii. Text messages: Opt out of receiving marketing-related texts by following the unsubscribe instructions included in texts you receive.
iii. Postal mail: Opt out of receiving marketing-related mail by emailing us at careteam@ontarionet.com. Note that even if you unsubscribe, you could still receive mail when we use a bulk mailing service that delivers to all homes within a ZIP code.
E. Customer Proprietary Network Information. You may limit OntarioNet’s use and sharing of a certain type of customer information, known as Customer Proprietary Network Information (“CPNI”) for marketing services, other than the ones we currently provide to you, by emailing us at careteam@ontarionet.com. CPNI is information that relates to the type, quantity, destination, technical configuration, location, amount of use, and related billing information of your Services.
F. Non-Discrimination. OntarioNet will not discriminate against you if you exercise any of the above options pertaining to your control over the Personal Information OntarioNet collects or shares about you.
A. We use technical, administrative and physical safeguards to help protect against unauthorized access to, use or disclosure of information we collect or store. In addition, we train our employees on the importance of privacy and security, as well as the proper ways to access, use and disclose customer information. Our practices and policies prohibit employees with whom we share this information from using sensitive information unless they are authorized to do so and have a business need.
B. Although we strive to keep information secure, we can’t guarantee that our safeguards will prevent every unauthorized attempt to access, use or disclose Personal Information. We use our security and incident response plans to handle such incidents. If you become aware of a security issue, contact careteam@ontarionet.com.
8. CHILDREN’S PRIVACY
Our Website is not intended for children under 18 years of age. No one under age 18 may provide any personal information to the Website. We do not knowingly collect Personal Information from anyone under the age of 18. If you believe that a child under 18 years of age has provided us with Personal Information, please contact us at careteam@ontarionet.com.
9. DO NOT TRACK POLICY
Some browsers have incorporated “Do Not Track” mechanisms. Most of these mechanisms, when turned on, send a signal to the website or online service indicating that the user does not wish to be tracked online. However, because the providers of “Do Not Track” and similar signals do not yet operate according to common, industry-accepted standards, we currently do not respond to those signals. 10. NOTIFICATION OF CHANGES
Any changes to the Privacy Policy will be posted at: https://www.ontarionet.com. Your ongoing use of the Websites and Services after any amendments to this Privacy Policy means you accept the changes.
