BY USING OR PAYING FOR ONTARIONET RESIDENTIAL BROADBAND INTERNET SERVICES, CUSTOMER IS AGREEING TO BE BOUND BY THESE TERMS AND CONDITIONS IN ADDITION TO THE ONTARIONET RESIDENTIAL GENERAL TERMS AND CONDITIONS.

 

1.      DESCRIPTION OF INTERNET SERVICES

 Residential Broadband Internet Services (“Internet Services”) are delivered using either a fiber connection (“Fiber Internet”) or a fixed wireless connection (“Fixed Wireless Internet”), depending on the service location. Certain Internet Services, or features of Internet Services, may not be available in all service areas and may change from time to time, in OntarioNet’s sole discretion.

2.      INSTALLATION

A.                Fiber Internet Equipment and Installation

If Fiber Internet service equipment is not already installed at your service location or is not usable, OntarioNet will have to install equipment and cables. The standard installation for Fiber Internet requires an Optical Network Terminal (ONT) on the outside or inside of your service location building and a fiber optic cable connecting the OntarioNet network in the street to the ONT installed on or in your building. The fiber optic cable will run from the external or internal ONT to the interior of your service location where it will be connected to a WiFi enabled router installed inside the building. Both the ONT and the WiFi enabled router will be plugged into standard power outlets.

B.                 Fixed Wireless Internet Equipment and Installation

If Fixed Wireless Internet service equipment is not already installed at your service location or is not usable, OntarioNet will have to install equipment and cables. The standard installation for Fixed Wireless Internet includes the mounting of a wireless receiver attached to the outside of your service location and a WiFi enabled router located inside your service location, the routing of cable(s) by the most direct path to one router inside the service location. Fishing of walls and/or attic crawling is not included with the Fixed Wireless standard installation. Both the wireless receiver and the WiFi enabled router will be plugged into standard power outlets.

3.      INTERNET SERVICE SPEEDS, BANDWIDTH AND USAGE LIMITS

OntarioNet will use commercially reasonable efforts to deliver the Internet speed attributable to the bandwidth for the Internet Service selected by Customer, however, actual speed, also known as throughput rate, may vary. You understand and agree that: (1) ONTARIONET DOES NOT WARRANT OR GUARANTEE THAT ANY PARTICULAR AMOUNT OF BANDWIDTH ON THE ONTARIONET NETWORK OR THAT ANY SPEED OR DATA THROUGHPUT OF YOUR CONNECTION TO THE ONTARIONET NETWORK WILL BE AVAILABLE TO YOU; (2) THE SPEED OF THE INTERNET SERVICES PROVIDED AT YOUR SERVICE LOCATION WILL VARY DEPENDING UPON A NUMBER OF FACTORS, INCLUDING YOUR COMPUTER SYSTEM(S) AND ASSOCIATED EQUIPMENT (E.G., CUSTOMER-SOURCED WIFI ROUTERS/ACCESS POINTS, ETC.), INTERNET TRAFFIC, AND OTHER FACTORS SUCH AS SYSTEM CAPACITY LIMITATIONS, GOVERNMENTAL ACTIONS, EVENTS BEYOND ONTARIONET'S CONTROL, AND SYSTEM FAILURES, MODIFICATIONS, UPGRADES AND REPAIRS; AND (3) YOUR WIRELESS CONNECTIONS AND USE OF WIRELESS ROUTERS MAY BE SUBJECT TO GREATER FLUCTUATIONS IN SPEED AND LATENCY AND MAY BE ADVERSELY AFFECTED BY INTERFERENCE, CONGESTION, DISTANCE, AND OTHER OUTSIDE FACTORS.

OntarioNet does not currently apply a monthly data usage limit or cap to Internet Services. We retain the right to trial or adopt data usage thresholds or other usage plans for the Internet Services at any time. If we do this we will notify you in advance.

4.      SECURITY

You acknowledge and agree that when using the Internet Services to access the Internet or any other online network or service or website, there are certain risks that may enable other Internet users to gain access to or use of your equipment. You are responsible for taking and should take all appropriate security measures when using the Internet Services. You assume sole responsibility for your equipment used in conjunction with the Internet Services and for providing and configuring any "firewall" or security measures for use with the Internet Services to prevent damage from viruses, malware, or other similar malicious items and to prevent unauthorized access to the Internet Services, and you, not OntarioNet, shall be solely responsible in any manner for the effectiveness of these blocking and filtering technologies. OntarioNet does not warrant that others will be unable to gain access to your computer(s) and/or data even if you utilize blocking and filtering technologies, nor does OntarioNet warrant that the data or files will be free from computer viruses or other harmful components. OntarioNet has no responsibility and assumes no liability for the protections you may employ nor for any damages that may arise from accessing the Internet. You shall not permit or enable any use of your account or account passwords by any person not a member of your household. You are responsible for any misuse of the Internet Services that occurs through your account whether by a member of your household or unauthorized third party.

5.      ANTI-SPAM SOFTWARE

You acknowledge and understand that OntarioNet utilizes anti-spam software and that such security technology is a feature of the Internet Service that may block incoming and outgoing electronic mail. OntarioNet does not warrant that such feature will block all unwanted mail/spam or that all mail that is blocked constitutes unwanted mail/ spam. Consistent with other statements set forth in this section, OntarioNet does not warrant that such feature will be error-free.

6.      SECURITY SOFTWARE

In its sole discretion, OntarioNet may make available to Customer security software, such as anti-virus software, firewall software, “pop-up” advertising blocking software, parental control software, and anti-spyware or anti-adware software for Customer's use on Customer's computer system in conjunction with the Internet Services. Any such security software provided by OntarioNet to Customer is intended to provide only a minimal level of protection to Customer's computer system(s). Customer understands and agrees that OntarioNet and its third party suppliers of any such security software do not guarantee its accuracy, efficacy or performance. Customer understands and agrees that OntarioNet and its third party suppliers are not responsible for any damage to Customer's computer system(s) or the information stored on it that may result from the security software or its non-performance.

7.      THIRD PARTY SITES

OntarioNet has no control over the information you may encounter by using the Internet Service, and we are not liable or responsible for the content or accuracy of any information obtained by you through the Internet as a result of your use of our Internet Service. You may find materials on the Internet which are offensive or inappropriate. You understand that your use of the Internet Service is at your own discretion.

8.      CLOUD BACKUP SERVICE

OntarioNet is not the manufacturer or supplier of any cloud backup service software components. Customer shall be solely responsible for updating cloud backup service from time-to-time based on updates provided by the software manufacturer. Customer understands and acknowledges that (1) it is Customer’s sole responsibility to create and retain the cloud backup service password that is necessary for access to any data stored via the cloud backup service and (2) OntarioNet has no access to and does not know nor keep any record of the password created by Customer.

9.       OPTIONAL INTERNET SERVICE FEATURES

OntarioNet offers various Internet Service features that a Customer may add to its selected Internet Service plan. Customer must purchase OntarioNet Internet Service in order to purchase and use any of the available features. Such features may change from time to time in OntarioNet’s sole discretion.

A.    SmartHome (Managed WiFi). SmartHome is a managed WiFi application which proactively keeps malicious websites, viruses, and intrusions away and allows Customers to easily create online rules for its users and devices within its Service Location network.

B.     Mesh WiFi. Mesh WiFi uses multiple interconnected nodes or access points to provide seamless, widespread Wi-Fi coverage throughout a larger area. The nodes communicate with each other to eliminate dead zones and ensure a strong signal everywhere.

C.     Outdoor WiFi. Outdoor Wi-Fi is designed for use in outdoor environments. It involves specialized routers or access points that can withstand weather conditions and provide reliable connectivity over larger outdoor areas.

D.    Static IP. Customers can get a fixed, unchanging IP address assigned to its internet connection. Static IP addresses are useful for hosting servers or accessing devices remotely, as it provides a consistent address rather than a dynamic one that can change.
