OntarioNet is committed to providing an exceptional user experience that supports any lawful product, service, or application that its customers choose to access through OntarioNet’s Internet service. To do so, OntarioNet engages in the reasonable network management practices described herein. Please note that use of OntarioNet’s Internet service is governed by various service terms and policies that are available at: https://www.ontarionet.com.
1. CONGESTION MANAGEMENT
OntarioNet proactively monitors its network to ensure high-quality service. This includes the active monitoring of its network for utilization analytics which is then used to plan and implement increases in available bandwidth, port additions or additional connectivity to the Internet which enhances our service and overall user experience. Without effective network management practices, customers would be subject to the negative effects of spam, viruses, security attacks, network congestion, and other risks or degradation of the service. OntarioNet makes all efforts to ensure adequate bandwidth is available to all customers and reserves the right to employ additional congestion management practices in the future or as required by law enforcement.
2. USER-BASED PRACTICES
OntarioNet offers a selection of Internet access service offerings to meet customers’ budgetary and usage needs. However, OntarioNet does not charge customers a usage-based fee for Internet access service. We do not employ volume-based data caps nor do we employ different practices based on a “user” type. OntarioNet manages its network to provide all customers a secure and optimal Internet experience. We monitor the flow of traffic on our network, including the amount of data sent to and from customer connections, the source and destination of data, and the type (but not the contents) of information sent and received. In limited circumstances, we may also review the contents of the information to determine whether it is malicious (such as spam, malware, or a virus) or when required by law. We continually implement best practices and industry standards to our security and network management tools based on network technology needs.
3. NO PAID PRIORITIZATION
OntarioNet does not directly or indirectly favor some traffic over other traffic (such as through prioritization, resource reservation, or traffic shaping) in its provision of its Internet service in exchange for consideration (monetary or otherwise) from a third party.
4. NO BLOCKING, THROTTLING, OR MODIFICATIONS OF PARTICULAR PROTOCOLS
OntarioNet does not favor certain websites or internet applications by blocking or throttling lawful internet traffic on the basis of content, application, service, user, or use of non-harmful devices on its Internet service. OntarioNet does not modify particular protocols, protocol ports, or protocol fields in ways not prescribed by the protocol standards. However, in response to a specific security threat against our network or our customers, OntarioNet may occasionally need to limit the flow of traffic from certain locations or take other appropriate actions.
5. ATTACHMENT OF DEVICES
OntarioNet customers may not physically attach any devices to or otherwise alter OntarioNet Equipment without OntarioNet’s prior written consent. Customers seeking approval to physically attach a device to OntarioNet Equipment must submit their requests to OntarioNet at careteam@ontarionet.com.
6. END-USER SECURITY; NETWORK SECURITY
OntarioNet engages in network management practices intended to address threats to its customers and network. We also encourage customers to adopt their own security practices.
a) End-User Security. OntarioNet uses technical, administrative and physical safeguards to help protect against unauthorized access to, use or disclosure of information we collect or store. In addition, we train our employees on the importance of privacy and security, as well as the proper ways to access, use and disclose customer information. Our practices and policies prohibit employees with whom we share this information from using sensitive information unless they are authorized to do so and have a business need.
Although we strive to keep information secure, we can’t guarantee that our safeguards will prevent every unauthorized attempt to access, use or disclose personal information. We use our security and incident response plans to handle such incidents. If you become aware of a security issue, contact careteam@ontarionet.com.
b) Network Security. OntarioNet employs certain practices to maintain the security of our network from unwanted and harmful activities. These include practices designed to protect our servers against denial of service attacks and to prevent malware, spyware, spam and identity theft. We may use a variety of security measures to protect the network, including blocking malicious or unlawful traffic, redirecting the flow of traffic over some portions of our network, or taking other actions to address the threat. To preserve the effectiveness of our security practices, we do not publicly disclose specific information detailing the levels and types of activities that may trigger our deployment of security protection measures.
When security measures are employed, they may affect performance characteristics of the service or the ability to access certain suspicious websites, but such measures are employed in a manner designed to have non-discriminatory impact on all similarly-situated customers and end-users. Customers whose conduct abuses or threatens OntarioNet’s network or which violates the OntarioNet Residenital General Terms and Conditions, Privacy Policy, or Acceptable Use Policy will be requested to stop any such use immediately. A failure to respond to such request or to cease such conduct could result in service suspension or termination.
7. NETWORK PERFORMANCE CHARACTERISTICS
OntarioNet offers a selection of Internet service offerings to meet customers’ usage needs. Each of these offerings support web browsing, video streaming, video conferencing, online gaming, sending and receiving emails, large file transfers and downloads, cloud services and storage, multiple device usage, and music streaming. The level of speed and multiple device capabilities will vary depending on the service offering selected by you.
OntarioNet will use commercially reasonable efforts to achieve the Internet speed attributable to the bandwidth for the offering selected by you, however, actual speed, also known as throughput rate, may vary. The speed of the offering selected will vary depending upon a number of factors, including:
Your computer system(s) and associated equipment (e.g., Customer-sourced WiFi routers/access points, etc.). Out-of-date hardware and system capacity limitations may cause your network speed to slow down. Further, bandwidth is provided on a per-customer basis and is shared by all connected devices within the customer's premises
Internet Traffic. Once your communication leaves the OntarioNet’s fiber network, we can’t ensure you’ll receive maximum speeds due to heavy traffic or substantial rerouting delays at any time. Performance may also be lower during peak usage times.
Latency. Latency is the measurement of how long it takes to transmit or receive packets on a particular network, and is affected by how far packets need to travel, how many network packets need to travel over, and the quality of those networks.
Packet Loss. Like latency, packet loss can have a number of different causes, including network congestion, faulty hardware, poor device performance or the presence of software bugs.
In addition to its Internet service, OntarioNet also offers customized commercial Internet services (“Non-BIAS Services”). These Non-BIAS Services share OntarioNet’s network infrastructure and thus can impact the availability or performance of our Internet service. OntarioNet implements industry best practices to ensure the performance of its Internet services are not adversely affected by the provision of our Non-BIAS Services.
